The Internet Crime Complaint Center. (IC3) This organization is a partnership between the Federal Bureau of Investigation (FBI), the National White Collar Crime Center (NW3C), and the Bureau of Justice Assistance (BJA). Apparently the FBI is coming down hard on counterfiet sellers and distributors. I talked with someone there today and he said that it is illegal to sell the bags, but not illegal to buy them. Go figure.
Oh, and then I talked to my friend who is local there and she said that she is suspect about 2 of the bags she was sold. This ticked me off as I bought from this woman on her recommendation.

Paypal says that the only way I have recourse is if I buy through Ebay. That way Ebay has pictures of what the bag looks like when it was purchased. Also, they won't refund for conterfeits. They will only refund if the bag is not received. So if you get sold a bag on Ebay and it's fake, your still out of luck with Paypal.

Oh, and I'll post the pics of this bag tomorrow. I'm not able to downsize them enough to upload them onto the site.

PayPal is full of sh*t because my friend sold an authentic Chanel jacket. This woman bought it and claimed it was fake and paid someone to say the same thing. My friend had a receipt and everything. Anyway, they refunded the woman her money because she said it was fake. They need to get their stories right. That p*sses me off. I can not wait until there is another reliable way to pay on the internet.

You should definately send the letter and file a claim with IC3 as well as take her to Court if need be. It is probably a good thing that she refused it because now you have the proof in your possesion. I am so sorry that you're going through this.

But just remember, I bought outside of Ebay. Paypal is claming that there is a bigger chance of refund if it is through Ebay because they have more pictures and descriptions to work with. Or some kind of garbage like that. Either way, I'm gun shy now.

But you shouldn't be. There are many reputable sellers on Ebay that have a ton of positive feedback. This was totally a random purchase and from a brick and mortar store. I thought Paypal would cover me and found out differently. But again, if you are purchasing from reputable sellers, there shouldn't be a problem.

I take it in a week ago and have it authenticated. It isn't real. I call her store. No answer. I email her. No response. So today I filed with Paypal and clicked to escalate it because I hadn't heard anything from her. But because I put "counterfeit goods" when Paypal wanted to know what the issue was, Paypal closed the dispute saying that didn't fall under the correct heading for getting your money back. Mind you, I've already sent the bag back to her so I am now out the bag and the money. Help! Where can I go from here?
I've already sent a letter to Paypal about it and will call tomorrow, but I need more ammo. Would it be mail fraud perchance? Anyone?
Why in the world did you send the bag back to her without hearing from her? Why did you send the bag back? Its your proof!!! Girl I can understand your frustration. NEVER buy high end stuff online. I just dont trust people no matter what. $1000!!! Girl, I feel your pain!

I'm so glad you are getting somewhere with this. It will just take some time. You're right...there are some great sellers on Ebay but some people ruin it for everyone. I usually only buy fro people I know or get the auction okayed by people who really know how to tell if it's fake or real.

Some people have no conscience. I mean, I could never sell someone a bag, claim it was real, and charge them close to full retail price, even if the bag looked completely authentic. I would feel like my karma would come and get me or something.

I agree. These days its hard to tell if a bag is real or not; they have such good knock offs so I am not sure that it would be right to sell a bag that looked just like the real thing if it wasnt and try to pass it off. Whoever that was it setting up bad karma...dont worry it will come back to get them sooner or later.

So I sent her this letter by email and was refunded the next day.

At this point, you have two options. The first is to send me the money you owe me for this fake bag, plus the shipping of said bag. I will send the bag back to you after I receive the refund, as they will be used for below if I am not refunded.
If you do not refund me for the money you owe, I will do two things. The first is file a claim in Small Claims court. Not only will it cost you money to defend yourself and the counterfeit bag, but your entire business practices will be out in the open for everyone to see. And FYI, it is illegal to sell counterfeit bags, not purchase them.
And then second I will file a complaint with the The Internet Crime Complaint Center. (IC3) This organization is a partnership between the Federal Bureau of Investigation (FBI), the National White Collar Crime Center (NW3C), and the Bureau of Justice Assistance (BJA). Apparently the FBI is coming down hard on counterfiet sellers and distributors. They will have all of your information once I file the report.
I suggest you do the right thing.

Well you told her! Good for you for getting on top of this right away. This is serious and hopefully she will respond in a courteous and professional matter so that things wont have to escalate further than they already have.
BTW I did not know that it was illegal to sell and not purchase bags. I thought everyone was wrong so now I understand why people arnt arrested for owning/making a bad purchase. It all makes so much since to me now. Thanks for sharing your letter.
    How inspiring!
