Well, he could but he wouldn't win. Legally once a piece of jewelry is given to another person, it is considered a gift and no longer their property. The only way said man could get the ring back would be to marry her and go after it in the divorce settlement.
Which leads one to really know the person you spend that kind of money on. And even more so if you are going to give them a family heirloom that means something to the family. I had a friend give his ex finacee a family ring and he was not able to get it back. And he took her to court and everything. It was really sad and what a total waste of a human being she turned out to be.
